Terms & Conditions

These Terms & Conditions apply when you shop with Target Furniture instore or online in New Zealand. Please read them carefully – they sit alongside your rights under New Zealand consumer law.

By using this website or placing an order with us, you agree to these Terms.

Definitions
In these Terms, unless the context says otherwise:
  • “Target Furniture”, “we”, “us”, “our” means Target Furniture Franchise (NZ) Limited (NZBN 9429036681617), the supplier of the Goods.
  • “you”, “your” means the Customer.
  • “Customer” means the person or entity purchasing Goods from us (and includes anyone acting on their behalf).
  • “Goods” means all goods supplied by us to you, as described in any order form, invoice, delivery slip or similar document. [cite: 10] Each such document is treated as agreed by you and forms part of these Terms.
  • “PPSA” means the Personal Property Securities Act 1999 (as amended or replaced).

Nothing in these Terms is intended to limit any rights you may have under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, where those laws apply and you are a consumer.

1. General
1.1

These Terms apply to all sales of Goods by Target Furniture to you, unless we agree something different with you in writing.

1.2

If there is ever a conflict between these Terms and anything else you’re told (including instore, online or in marketing material), these Terms will usually apply. If New Zealand law says something different must happen, the law will win.

1.3

We may update these Terms from time to time by posting the updated version on our website. The version in place when you place your order will apply to that order (unless we both agree otherwise or the law requires a change).

2. Retention of Title (Who Owns the Goods)
2.1

You take ownership of the Goods only once we’ve received full payment for them. Until then, we still own the Goods and hold a security interest in them under the PPSA.

2.2

Until you’ve paid in full:

  • You hold the Goods as our bailee and must look after them, keep them safely stored, and not alter or damage them on purpose.
  • If the Goods are attached to, mixed with, or become part of other items, our interest continues in those combined items to the value of the Goods we supplied.
  • If you sell the Goods to someone else before paying us, you do so as our agent and must hold the part of the proceeds that relates to those Goods on trust for us until what you owe us is paid.

2.3

You agree that we may register a financing statement on the Personal Property Securities Register to protect our security interest in the Goods.

2.4

If you don’t pay us when you’re supposed to, we may (as far as the law allows):

  • enter the premises where the Goods are stored, and
  • take back possession of the Goods.

We’ll act reasonably when doing this and will follow all legal requirements.

3. Information, Privacy & Marketing
3.1

We collect personal information from you so we can:

  • process and deliver your orders,
  • manage your account and payment,
  • handle returns, warranties and customer service, and
  • (where you’ve agreed) send you marketing, offers and updates.

We handle personal information in line with the Privacy Act 2020 and its privacy principles.

3.2

You authorise us to:

  • collect information about you from you and, where reasonable, from third parties (for example credit agencies, delivery partners, or payment providers),
  • hold that information securely, and
  • use and share it with trusted third parties where it’s reasonably needed to run our business (for example, deliveries, payment processing, customer service, IT support or debt collection).

3.3

We’ll take reasonable steps to keep your personal information safe and to make sure it’s accurate and up to date.

3.4

You can ask to access and correct the personal information we hold about you at any time, subject to the limits set out in the Privacy Act 2020.

3.5

Marketing

If you opt in to receive marketing from us (for example, by signing up to our email list or using a promotion), you agree that we may send you information about products, offers and promotions. You can unsubscribe at any time by following the instructions in our emails or contacting us.

4. Risk (Who Carries the Risk)
4.1

Risk in the Goods (for example, loss or damage) passes to you once we part with possession of them:

  • usually when the Goods leave our warehouse or store, or
  • if we’re delivering to you, when the Goods are unloaded from the delivery vehicle at your address.

From that point, you’re responsible for insuring the Goods if you want them covered.

5. Delivery & Freight
5.1

General delivery

We’ll always do our best to meet any delivery dates or timeframes we’ve given you. Sometimes delays happen that are outside our control (for example, courier delays, weather events, traffic, stock or supply issues). We’re not liable for delays caused by things reasonably outside our control, but we’ll keep you informed and work to get your order to you as soon as we can.

5.2

Delivery point & checking your order

Unless we agree otherwise in writing, delivery occurs when:

  • the Goods leave our premises; or
  • if we’ve agreed to deliver to you, when the Goods are unloaded at your address.

Please check your order for any obvious transit damage while the carrier is still there. Any damage should be noted on the carrier’s delivery docket and reported to us as soon as possible so we can look into it.

5.3

Missing items

We check our shipments before they leave our warehouse. If you believe something is missing from your order, please contact Target Furniture straight away so we can investigate and, if appropriate, fix the issue.

5.4

  • Some outer Auckland & Hamilton suburbs may be excluded.
  • Your delivery date will be confirmed by the store or our customer service team.

If your order doesn’t qualify for Next Day Delivery, we’ll still aim to get it to you as quickly as we reasonably can.

5.5

Order Today, Shipped Tomorrow – Outside Auckland, Hamilton & Selected Waikato Areas

Our “Order Today, Shipped Tomorrow” service refers to dispatch from our Auckland warehouse, and is subject to the following conditions:

  • Available on instock items only.
  • Orders must be placed before the closing time of your nearest store to qualify.
  • Eligible orders will be dispatched from our Auckland warehouse on the next business day.
  • Delivery timeframes will then depend on our freight partners and delivery networks and may vary by location.
  • Your delivery date will be confirmed by the store or our customer service team.

While we always aim to ensure prompt delivery, delays may occur due to factors outside our control (including courier and freight network disruptions). If this happens, our customer service team will keep you informed with updates.

5.6

Free Delivery on Your First Order

Free delivery on your first order is subject to:

  • Available to new email subscribers only.
  • One free delivery (up to a delivery value of NZD $100) applies to your first instore or online purchase when you spend NZD $1,499 or more in a single transaction.

By accepting this offer, you agree to receive marketing material from Target Furniture. We’ll treat your consent with respect and in line with New Zealand privacy law. We may change or withdraw this offer at any time, but any change won’t affect orders we’ve already accepted.

6. Pricing
6.1

Prices can change from time to time. The price you pay is the one we confirm when we accept your order (for example, on your invoice or order confirmation).

Unless we say otherwise:

  • freight or delivery charges are additional, and
  • prices are inclusive of GST.

6.2

Pricing errors

Very occasionally our system may display a price incorrectly (for example, $0.00 or a clearly wrong price). While we do our best to avoid this, such prices can’t be honoured. If you place an order at an incorrect price, we’ll let you know and give you the option of cancelling the order or continuing at the correct price.

6.3

Currency

All prices shown on targetfurniture.co.nz are in New Zealand dollars (NZD) and are inclusive of GST unless stated otherwise.

7. Terms of Payment
7.1

Unless we agree otherwise in writing, full payment is required before delivery of the Goods (including outofstore deliveries). We usually don’t issue monthly statements – your invoice is your record of purchase.

7.2

Overdue amounts

  • If you don’t pay an amount when it’s due, we may charge interest on the overdue amount at the rate shown on your invoice (or a reasonable default rate if none is stated).
  • You’re responsible for all reasonable costs we incur in enforcing these Terms or recovering overdue amounts from you (including legal and collection costs on a full indemnity basis, where the law permits).

7.3

Any cheque, product credit, bill of exchange or other negotiable instrument you give us won’t be treated as payment until it has actually been paid or honoured.

7.4

Default

If you default on any payment:

  • all amounts you owe us (on any account) may become immediately due and payable; and
  • we may exercise any of our rights under these Terms (including our retentionoftitle and recovery rights).

8. Online Product Availability
8.1

We work hard to keep accurate stock levels on our website, but stock moves quickly and availability can change. We can’t guarantee that every product shown online will be available at all times.

8.2

If we can’t supply a product you’ve ordered online:

  • we’ll let you know by email or phone, and
  • any amount charged to your card for that product (including applicable delivery charges) will be refunded as soon as reasonably possible.

To the maximum extent the law allows, Target Furniture isn’t liable for any loss caused by shortterm stock shortages.

9. Consumer Guarantees, Fair Trading & Your Rights
9.1

Personal / household use

If you’re buying Goods normally used for personal, domestic or household purposes, you may have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These laws give you guarantees around things like acceptable quality, fitness for purpose and accurate representations, and provide remedies (such as repair, replacement or refund) if those guarantees aren’t met. Nothing in these Terms is intended to limit those rights.

9.2

Business use / in trade

If you tell us (or it’s clear from the circumstances) that you’re acquiring the Goods for business purposes (for example, for use in a commercial setting or for resale), then:

  • to the extent the law allows, the Consumer Guarantees Act 1993 does not apply to that purchase; and
  • our liability to you is limited as set out in clauses 9.3 and 9.4.

9.3

No extra promises

Unless we’ve expressly agreed something in writing, we don’t make any extra promises or guarantees about the Goods beyond what is required by law or by the manufacturer’s written warranty.

9.4

Limiting our liability (especially for business purchases)

To the maximum extent the law allows:

  • we’re not liable for any loss of profits, loss of goodwill, loss of opportunity, loss of anticipated savings, or any indirect or consequential loss; and
  • for business purchases (where the Consumer Guarantees Act does not apply), our total liability to you for any claim relating to the Goods is limited, at our choice, to:
    • repairing the Goods, or
    • replacing the Goods, or
    • refunding the price you paid for the Goods.

If you think something has gone wrong with your purchase, please get in touch with us as soon as possible so we can work through it with you.

10. Warranty
10.1

Manufacturer warranties

Goods we supply may come with a manufacturer’s warranty. Any such warranty is provided by the manufacturer, not by us, and is subject to the terms and conditions set by that manufacturer.

10.2

We don’t give separate written warranties unless we clearly say so. If we do, the terms of that warranty will be provided to you.

10.3

Except as required by law or as expressly set out in these Terms, and to the maximum extent permitted by law, all other warranties, conditions or terms (whether implied by statute, common law or custom) are excluded.

11. Cancellations & Changes
11.1

Once we’ve accepted your order, you can’t cancel or change it without our agreement. We’ll try to help where we reasonably can, but we’re not obliged to accept cancellations.

11.2

If we do agree to cancel an order or accept Goods back into stock (other than where we’re legally required to do so):

  • the Goods must be in resellable condition (including original packaging where possible), and
  • a restocking fee of 15% of the price of the Goods returned may apply to help cover handling and administration costs.

This clause doesn’t limit your rights under the Consumer Guarantees Act 1993, where it applies.

12. Website & Information Disclaimer
12.1

We work hard to keep the information on our website (including product descriptions, dimensions, specifications, pricing and availability) accurate and up to date. From time to time, errors or omissions can occur or information may change without notice.

12.2

To the maximum extent the law allows, Target Furniture will not be liable for:

  • any inaccuracies, errors or omissions in the information on this website; or
  • any loss arising from your reliance on that information, where we’ve used reasonable care.

If something looks wrong on the site (for example, a clearly incorrect price or specification), please let us know – we’re always happy to check.

13. Assembly Terms (Arrives Assembled & Kitset)
13.1

Arrives assembled or minimal assembly

Most of our furniture is supplied assembled and ready for use. In some cases, minimal assembly may be required – for example attaching sofa legs, securing handles on drawers, or placing slats on a bed frame. Any such assembly is intended to be straightforward and not require specialised tools or skills.

13.2

Kitset range

A limited range of products is supplied as part of Target Furniture’s kitset range and is delivered in kitset (flatpack) form for you to assemble. Kitset products are clearly identified as such on the relevant product page. By purchasing a kitset product, you accept responsibility for assembling it in line with the instructions provided and using suitable tools.

13.3

Assembly support

If you need a hand with assembly, you’re welcome to call us on 0800 827 438 and we’ll do our best to talk you through it over the phone.

14. Imagery & Product Representation
14.1

How our images appear

We do our best to make sure our product photos, videos and other imagery are accurate and up to date. However, colours, textures and finishes can look different depending on your device, screen settings, lighting and viewing conditions. Because of this, we can’t guarantee that what you see on your screen will be an exact match to how the product looks in person.

14.2

AI-generated backgrounds and styling

From time to time we may use digital tools, including AI, to create or enhance backgrounds, room settings and accessories in our imagery. We do not use these tools to change the core design, dimensions or key features of the product itself. Where AI or other digital tools are used, it’s only to help show our products in context (for example, in a styled room), not to alter the photographic image of the actual product you are buying.

14.3

Props, accessories and styling

Unless we clearly say otherwise, any accessories, décor items or other products shown in our imagery are for styling purposes only and are not included with your purchase. Please refer to the product description and specifications for what is included and check measurements carefully to make sure the product is right for your space.

14.4

Your rights under New Zealand law

Nothing in this clause limits your rights under New Zealand law (including the Consumer Guarantees Act 1993 and Fair Trading Act 1986, where they apply). If there is a material difference between how a product is represented and what you receive, please get in touch with us so we can work it out with you.
